Above the Law: OKC Police Officer Charged in Domestic Dispute

A 16-year veteran of the Oklahoma City Police Department has been charged in connection with a domestic disturbance that took place in April.

Reports say that Mustang police responded on May 1 to a call about a person who might be suicidal. When they arrived at the home of Oklahoma City PoliceMaster Sgt. Gregory Douglas Driskill, 46, a woman told them that he had pushed her, causing to hurt her back. She also claimed that the previous night,on April 30, Driskill had held a gun to her head and threatened to kill her. Reports describe the relationship between Driskill and the woman as a"dating relationship."

Mustang police arrested Driskill, who was immediately placed on administrative leave by the Oklahoma City Police Department. Initially, he was arrestedon complaints of assault and battery with a deadly weapon and assault and battery.

He has since been formally charged in Canadian County District Court. The District Attorney's Office is charging Driskill with a felony count of pointinga firearm and a misdemeanor account of domestic abuse.

Oklahoma law prohibits pointing a firearm at another person with the intent to threaten in 21 O.S. � 1289.16:

It shall be unlawful for any person to willfully or without lawful cause point a shotgun, rifle or pistol, or any deadly weapon, whether loaded or not, at any person or persons for the purpose of threatening or with the intention of discharging the firearm or with any malice or for any purpose of injuring, either through physical injury or mental or emotional intimidation or for purposes of whimsy, humor or prank, or in anger or otherwise, but not to include the pointing of shotguns, rifles or pistols by law enforcement authorities in the performance of their duties, members of the state military forces in the performance of their duties, members of the federal military reserve and active military components in the performance of their duties, or any federal government law enforcement officer in the performance of any duty, or in the performance of a play on stage, rodeo, television or on film, or in defense of any person, one's home or property.

The subsequent section states that unlawful pointing of a firearm is a felony that carries a maximum sentence of 10 years in prison.

In most cases, domestic assault and battery is a misdemeanor; however, repeat offenses, domestic assault and battery with a dangerous weapon, domesticabuse by strangulation are felonies.

If a person is convicted of domestic violence, or if the person is subject to a victim's protective order, then according to the Brady Act, he or she islegally prohibited from firearm possession.
